Protocol No 5 of 2021

For in house and public issue

It should now be accepted that the COVID 19 Pandemic situation in Papua New Guinea will continue to be a matter of serious concern nationwide. The Judiciary has an important role to play and whilst we must adopt the strictest safety measures, we must also adapt our practices so that we still maintain our normal functions.

In consultation with the Chief Justice, Deputy Chief Justice and Secretary NJSS I now issue this Protocol No 5 of 2021 which will remain in force for 3 months from the date of release.

In view of the rise in COVID-19 cases and in consultation with the Acting Chief Justice, the Judges through the Acting Chief Justice and the Secretary. The Registrar of the Supreme & National Courts of PNG now issue this protocol as of Tuesday 30th March, 2021.

 Due to the recent spike in COVID-19 cases in Port Moresby and the country, The PNG Judiciary through the Office the Registrar has circulated the NJSS Covid-19 Protocol No.3 of 2021.  The Supreme and National Court has gone into two weeks of partial shut-down as such the Ceremonial Sitting for the Late Justice Regina Sagu has been restricted only to invited guest. NJSS COVID – 19 Protocols

Protocol No 3 of 2021

For Internal and Public Circulation

 

As of Monday 15 March 2021, four members of staff, two judges and two officers of corporate services have tested positive to COVID 19. Also noting the surge of infections this past weeks in NCD and nationwide and therefore in consultation with the Chief Justice, Deputy Chief Justice and Secretary NJSS a total Shut Down of the Courts operation for two weeks is now declared.

Practice Direction No 4 of 2020

 

 Juvenile Justice Track

This Practice Direction is issued in consultation with and authorised by the Chief Justice.

 

  1. The Judges as of June 2019 agreed to fully support the implementation of the Juvenile Justice Act, 2014.
  2. A Juvenile Justice Track is now established in the National Court Criminal Registry for the expressed purpose of maintaining a record of any criminal case filed against a juvenile.
  3. For the purposes of this rule, a juvenile is a person between the ages of 10 to 18 years.
  4. Where the Registry becomes aware that a case filed involves a child under the age of 10, this information should immediately be brought to the attention of the Judge Administrator for Crimes.
  5. All files created by the Registry as a Juvenile Justice file must be kept under a separate list and must not refer to a juvenile by his or her full name, but by their initials only.
  6. All cases involving Juveniles registered in the National Court shall have the following code;

       CR (JJ) No ----- of 20

    7. A Juvenile Justice Track-list shall now be created for all registries both in Waigani and in the provincial registries.

NJSS COVID – 19 STATE OF EMEGERNCY PROTOCOLS 2020.

Public Notice NO 2 of 2020

This notice is issued pursuant to a decision made by Judges on the 08th of May 2020 on the;

  1. The Judiciary recognizes the efforts of the Government to manage Covid 19 issues through the State of Emergency Orders.
  2. The Courts will resume operations as of the 11th May 2020 on a restricted and staggered manner as laid down in NJSS Protocol No 2 of 2020.
  3. Public Access to the Courts will be restricted and subject to protocols issued under NJSS Protocol NO 2 of 2020

    3. Hand cleanliness

          Continues as required by the SOE orders and NJSS Protocols

  1. All Court sittings as of the 11th May 2020 will be subject to individual judges who manage their own lists.

Practice Direction No 2 of 2020

     COVID-19 Teleconference Sittings

This Practice Direction is issued after consultation with the Chief Justice

Pursuant to the PNG Judiciary COVID-19 Response Notice issued by the Chief Justice on Wednesday 18 March 2020, I now issue the following instructions on the use of teleconference sittings.

  1. During the State of Emergency imposed by the Executive Government, the Judiciary will be conducting hearing for matters that are considered urgent or for specific purposes only as approved.
  2. A list of judges as approved by the Chief Justice will preside over such matters in Courtrooms 8, 9 and 1 as approved.
  3. Courtrooms 8 and 9 are now equipped with telephone conferencing equipment which will now be utilised for case hearing over the phone line.
  4. Protocol for access to listing of a matter;
    1. A new matter or existing matter is brought to the attention of the Registrar or a Deputy Registrar as being urgent.
      1. This will be done by way of e-filing or filing through email
      2. An appropriate letter expression urgency must also be sent to the Registrar.
  5. The request is brought to the attention of the Deputy Chief Justice.
  6. Once approved the matter is placed on a list of matters to be heard on a given day.
  7. Matters are listed 20 minutes apart by the Registry commencing at 9:30 am or 1:30 pm or as directed by a Judge.
  8. Lawyers or litigants are advised by the Registry of the date and time of hearing.
  9. Lawyers or Litigants are required to provide a phone number of a landline to which the court will call. Where landline is not available the lawyer or litigant can provide a number for a mobile phone provided;
    1. The mobile phone is one where it is capable of having sufficient frequency
    2. The mobile phone is fully charged
    3. The mobile phone is located at a place where the mobile reception is very clear, and the frequency does not fluctuate.
  10. Ten minutes prior to a hearing the lawyer and or the litigant must be ready to receive a call from the Court.
  11. The associate to the presiding judge will call the lawyer or litigant whose case appears first on the list at or around 9:20 am
    1. The case will proceed thereafter;
    2. Lawyers and litigants second on the list of cases and others thereafter listed must be ready to receive a call from the Court twenty minutes or so thereafter.
    3. The practice is the same at 1:20 pm.
  12. Where a matter is adjourned to a later date during the SOE, appropriate directions will be issued by the Court.
  13. Protocol for the conduct of the hearing;
    1. A lawyer or litigant who is called upon to use the teleconference facilities must;
      1. On answering the call state, his or her name and her role in the case.
      2. Must wait for the other party to respond in the same manner if also called upon by the Court.
      3. Both lawyers and litigants after being introduced must wait to be called upon by the presiding judge to address the Court.
      4. When speaking the lawyer or litigant must again identify himself or herself before addressing the Court to assist with correct identification of the speaker for transcription purposes.
      5. This protocol should be followed until the hearing is concluded.
  14. Orders- decisions
    1. At the end of the proceedings, the Lawyer/ Litigant granted any order or decision must send a draft to the associate for endorsement unless the Court is able to release a signed version of the order before the day’s end.
    2. After endorsement by the associate, the Registrar will sign and issue a sealed copy of the order- decision to all concerned.

Port Moresby Papua New Guinea NJSS COVID – 19 Protocols Protocol No 3 of 2021 For Internal and Public Circulation As of Monday 15 March 2021, four members of staff, two judges and two officers of corporate services have tested positive to COVID 19. Also noting the surge of infections this past weeks in NCD and nationwide and therefore in consultation with the Chief Justice, Deputy Chief Justice and Secretary NJSS a total Shut Down of the Courts operation for two weeks is now declared. PROTOCOL NO 1.1 – Total Shut Down of the Establishment 1. As of Monday the 15th of March 2021, the Court will go into total shutdown for 2 weeks to be reviewed on Friday 29th March 2021. PROTOCOL NO 1.2 Urgent hearings only. 2. Judges will Continue to work in chambers or from home. 3. Judge personal staff will continue to work in chambers if requested by Judges. 4. All Courtrooms will be closed except for Courtroom 8 and 9. 5. All cases listed for the next two weeks are now adjourned to March 30 for further directions. 6. Only cases considered to be urgent will be heard by way of electronic hearing, these includes. 6.1.1 Bail 6.1.2 Deportation 6.1.3 Life or death situations 6.1.4 Evictions 6.1.5 Commercial cases where considerable hardship will ensure if court does not intervene. 6.1.6 For exceptional circumstances such as a ceremonial sitting. 7. All Officers must now undergo compulsory testing. 12. The COVID 19 team will organize with the NCD Health Division or the National Health Department to organize test to be conducted on site. 13. However, all staff must also take the initiative to go for testing at a suburban clinic nearest to your place of residence. Testing can be conducted at free urban clinics. PROTOCOL NO 1.4 – Essential Staff 14. Number of essential staff is now reduced to 5 per division. 15. The divisional manager is responsible for the selection of these staff PROTOCOL NO 1.5 – Provincial Courts and Registries 15.16. Where a provincial center is facing similar situation as Port Moresby, this protocol can be adopted and applied in such a province. 16.17. The provincial judge administrator and Assistant Registrar may after seeking specific approval of the Chief Justice, shut down the court for 2 weeks or any other period as considered appropriate. It is to be noted that this is not a holiday for Judges and Staff. It is recommended that all Judges and Staff exercise extreme caution and stay safe during this lockdown period.
